SitusAMC Data Breach Settlement: How to Claim by November 6

Got a SitusAMC data breach notice? File by Nov. 6 for an estimated $75 or documented losses up to $5,000. Opting out and objecting close Oct. 22, two weeks earlier.

Published

If SitusAMC Holdings Corporation sent you a notice about its November 2025 data incident, you have until November 6, 2026 to claim a share of a $5,300,000 settlement. The settlement website says “The only way to receive cash benefits from this Settlement is by submitting a valid and timely Claim Form.” One date comes first and matters more than it looks: opting out and objecting both close October 22, two weeks before the claim deadline, and staying in releases more than claims against SitusAMC.

The quick answer

  • Who is in: “All persons in the United States who were sent notice of the Data Incident as identified in the Class List”
  • Credit monitoring: one year, with an enrollment code you were sent automatically and “$1,000,000 identity theft insurance with no deductible”
  • Cash Payment A, documented losses: up to $5,000 with third-party proof
  • Cash Payment B, no proof: estimated at $75, and it “could be higher or lower.” You can take it “in lieu of or in addition to” Payment A
  • California extra: $50 more if you lived in California from November 12 to November 22, 2025, also pro rata
  • Deadline: November 6, 2026 online, or mailed with a postmark by that date. You need the Login ID and PIN from your postcard notice
  • Opt-out and objection deadline: October 22, 2026
  • Court status: the final approval hearing is November 11, 2026. Payments come after approval and any appeals

Diagram: your benefits in the SitusAMC data breach settlement, one year of credit monitoring, a documented loss payment of up to 5,000 dollars, an estimated 75 dollar flat payment you can take in addition, and a 50 dollar California payment, with the October 22 opt-out date and the November 6 claim deadline

The date that comes first: October 22

Opting out or objecting is due October 22, 2026, which is 15 days before you can still file a claim. The FAQ says “To be timely, your Opt-Out Request must be postmarked by October 22, 2026.” Objections are due the same day, filed on the court’s docket or postmarked by it. If you object, you stay in: “You will still be eligible to receive Settlement benefits if the Settlement becomes final even if you object to the Settlement.”

Why the date matters here is the release. The FAQ says “unless you opt out, you will give up and release all of the Released Claims against the Released Parties.” The released parties are not only SitusAMC. The definition includes “current and former clients and customers of the SitusAMC Persons, whose information was compromised, accessed, exfiltrated, or otherwise impacted by the Data Incident,” and “any business associates and/or covered entities that owned or controlled data accessed, compromised, or otherwise impacted by the Data Incident.” In plain terms, companies that hired SitusAMC and whose customer information was caught up in the incident are among those you would release.

If you think you have a claim against a bank, lender, or other company that sent your information to SitusAMC, that is worth a call to a lawyer before October 22. Opting out means no payment and no credit monitoring from this settlement, and you keep the right to sue.

What the incident is

On or about November 12, 2025, SitusAMC “discovered that it had been the victim of the Data Incident, which involved the unauthorized access and exfiltration of certain information, including Personal Information,” and the data varied by person. It included “Social Security or individual taxpayer identification numbers” and “financial account numbers, medical records, and health insurance policy numbers,” among other details. SitusAMC’s position: “SitusAMC denies that it did anything wrong, and the Court has not decided in favor of any party.”

Who is in the class

The court’s definition is short: “All persons in the United States who were sent notice of the Data Incident as identified in the Class List.” Excluded are SitusAMC’s executive leadership team and the judge’s family and staff. If you were sent notice, you are on the list. If you are not sure, the FAQ says to ask the administrator by email, by phone at (833) 421-7329, or by mail at the P.O. box above.

The benefits

BenefitWhat you getWhat it takes
Credit monitoringOne year with credit file monitoring, dark web scanning, public record monitoring, identity restoration, and $1,000,000 identity theft insuranceUse the enrollment code sent to you
Cash Payment AUp to $5,000 for unreimbursed lossesThird-party proof such as receipts
Cash Payment BEstimated $75, one timeNothing to document
California Statutory Payment$50, pro rataLived in California Nov. 12 to Nov. 22, 2025

Unlike several recent settlements, the two cash options are not either-or. The claim says “In lieu of or in addition to submitting a claim for Cash Payment A,” you can take Payment B, so a person with documented losses can claim both. The California payment sits on top of whichever you choose.

What counts for Payment A: unreimbursed bank or card charges, the cost to replace a driver’s license, Social Security number, or other ID, unreimbursed credit report costs, and credit monitoring or identity theft protection first bought between November 12, 2025 and the claims deadline. For that last category you need proof of purchase and a written statement that it was bought primarily because of the incident. The rule on proof is firm: “You must submit third-party documentation, such as receipts, to verify the costs you incurred,” and “self-prepared documents by themselves are not sufficient to file a valid claim.”

What the $75 depends on

The $75 is an estimate, and the agreement shows why it can move. The fund pays out in a fixed order. Credit monitoring costs come first, then documented loss claims, then the California payments, and only then does the flat payment get what is left: “the remaining amount of the Net Settlement Fund shall be distributed pro rata.” The more valid claims there are for the earlier categories, the less remains for Payment B, and vice versa.

The $5,300,000 also has to cover “all costs associated with Credit Monitoring,” the administrator, and the lawyers. Class counsel will ask for fees of “up to one-third of the Settlement Fund” plus costs, which is about $1.77 million at the full third (our arithmetic). Service awards are “up to $2,500.00 for each Class Representative” for six named plaintiffs, or up to $15,000 in total (also our arithmetic). The agreement adds that “Defendant shall not be responsible for any other payments under the Settlement,” so there is no second pot behind the fund. SitusAMC was to put in $300,000 up front for the first notices and to fund the remaining $5,000,000 within ten days after the settlement takes effect.

How to file

Online. The claim page needs the Login ID and PIN on your postcard notice. The home page says the form “must include your unique Class Member Login ID and PIN found on the postcard notice sent to you or available from the Settlement Administrator.” If you lost them, email info@SAMCDataSettlement.com, and “Please request your ID & PIN by providing your full name and mailing address.”

By mail. Download the paper form from the site, sign it, and send it with your proof to the P.O. box above, postmarked by November 6, 2026. You can also ask the administrator to send you one.

Choosing how to be paid. The claim form lists PayPal, Venmo, Zelle, or a physical check. The agreement says “Cash Payments to Settlement Class Members will be made by electronic payment or by paper check,” and “Paper checks must be negotiated within ninety (90) days of issuance.” If money is not cashed or received in 90 days it lapses, and if there is enough left over, a second round goes to people who were paid in the first. Anything still unclaimed goes to “an appropriate cy pres recipient mutually agreed upon by the Parties and approved by the Court.”

If your claim has a problem. The administrator may send a Notice of Deficiency, and you have until the claim deadline or “fifteen (15) days from the date the Notice of Deficiency is sent,” whichever is later. If a documented claim is rejected and not fixed, “the Claim will be converted to Cash Payment B,” so you are not left with nothing.

The credit monitoring wording

The FAQ says “As a Settlement Class Member, you automatically received an enrollment code for one year of Credit Monitoring services.” The separate enrollment page tells a slightly different story: it offers “a reminder email notification with enrollment instructions for Financial Shield Complete once the Settlement becomes final.” Read together, you do not claim monitoring on the claim form, but the instructions may not arrive until the settlement is final. Look for the code on your notice, and use the enrollment page if you want the reminder.

The court has not approved it yet

The FAQ says “The Court will hold a Final Approval Hearing on November 11, 2026, at 10:00 a.m. Eastern Time.” You do not have to attend. The site’s wording on timing is “Settlement Class Member Benefits will be distributed if the Court grants final approval, and after any appeals are resolved,” and no payment date is posted.

What doing nothing means

Unless you opt out, you are in the class. If you do nothing, you get no cash and you still give up the right to sue the released parties over the incident.

Check that it is real

File only on the official site or by mail to the administrator’s P.O. box above. Treat any message that asks you to pay a fee to claim as suspect. The Login ID and PIN come from your own notice or from the administrator.

Is the SitusAMC settlement real? Yes. It is a federal class action, No. 1:25-cv-9748 in the Southern District of New York, with a $5,300,000 fund and a hearing on November 11, 2026.

How much will I get? Credit monitoring, plus an estimated $75 with no proof or up to $5,000 with proof, and you can take both cash options. California residents from Nov. 12 to Nov. 22, 2025 can add $50.

What is the SitusAMC claim deadline? November 6, 2026, online or mailed with a postmark by that date.

I lost my notice. Can I still file? Email info@SAMCDataSettlement.com with your full name and mailing address to get your Login ID and PIN.

Should I opt out? Only if you want to keep the right to sue. The deadline is October 22, and the release is broad enough to cover companies that used SitusAMC.

When will payments go out? After final approval and any appeals. The site has not posted a date.

Bottom line

If you got a SitusAMC notice, decide on October 22 first: staying in releases SitusAMC and the companies that used it, and opting out means no payment. Most people will stay in and file by November 6, 2026. Take the no-proof estimated $75, add documented losses if you have receipts, add the $50 if you lived in California in that window, and pick PayPal, Venmo, Zelle, or a check. The estimate can rise or fall with the number of claims.
